Are There Any Requirements?

An uncontested divorce is supposed to be simple and for the most part, it is. Here are a few basic pieces of information to be aware of going in:

  • If there are no children involved, you must demonstrate (and make a statement under oath) that you and your spouse have been living "separately" for at least six months. This doesn't mean you can't be living under the same roof. What it does mean is that you haven't slept together or had marital relations in the last six months.
  • If there are children, the living "separate" requirement is one year.
  • You and your spouse must have a signed settlement agreement resolving all of the significant issues, including child custody, visitation, child support, spousal support (if any) and the division of marital property.
